Excerpts from Intellectual Property Code

Article L111-1

“The author of a work of the mind has over the work, the mere fact of its creation, an exclusive incorporeal property right enforceable against all. This right includes intellectual and moral attributes and order attributes of an economic nature, which are determined by the books I and III of this Code.”

Article L335-2

“Any edition of writings, musical composition, drawing, painting or any other production, printed or engraved in whole or in part, regardless of the laws and regulations concerning author's property is a forgery and any forgery is an offense. In France, forgery of published in France or abroad works is punished by three years' imprisonment and a 300,000 euros fine. Will be punished the same flow, the export and import of counterfeit works. When the offenses provided for in this Article have been committed by an organized gang, the penalty is increased to five years' imprisonment and a fine of 500 000 euros.”

Article L335-3

“Is also a forgery offense all reproduction, representation or circulation by any means whatsoever of intellectual work in violation of the copyright, as defined and regulated by law. Is also an infringement of copyright infringement of any rights of the author of a software defined in Article L. 122”

Article L613-7

“Any person who, in good faith, to the filing date or priority date of a patent was, in the territory where this book is applicable in possession of the invention covered by the patent, has the right, as an individual, to exploit the invention despite the existence of the patent.
The right granted by this Article shall be transferred together with the trade, business or part of the business to which it is attached.”
